1. AGREEMENT TO WORK WITH JIFA

1.1 Parties and Scope

This agreement governs your relationship with Eric D. Jackson, Jackson Insurance & Financial Associates LLC ('JIFA,' 'we,' 'us,' or 'our'), our employees, contractors, and authorized representatives, as well as the insurance carriers, benefit administrators, technology partners, and third-party service providers we work with to deliver insurance and financial services to you.

By contacting us, requesting a quote, submitting information through our website, connecting your insurance policy through Canopy Connect, creating a financial profile through Asset-Map.com, scheduling an appointment, or purchasing any insurance or financial product through JIFA, you acknowledge that you have read, understood, and agreed to the terms and conditions set forth in this document.

1.2 Services Offered

JIFA is an independent insurance agency licensed to offer the following services in the states where we are licensed and in compliance with applicable law:

  • Personal and Commercial Property & Casualty (P&C) Insurance — through Canyon Lands Insurance / CLI Select network and directly appointed carriers
  • Life Insurance and Living Benefits — through direct carrier appointments
  • Fixed and Fixed Indexed Annuities — through direct carrier appointments
  • Group Health, Dental, Vision, Disability, and Ancillary Employee Benefits — in partnership with Emerson Rogers
  • Financial Planning Support Services and Coaching — including the use of Asset-Map.com for financial visualization (informational, not investment advice)
  • Securities and Investment Advisory Services — NOT currently offered. A RIA relationship is in development. No securities products are being offered or sold until proper registration is established and disclosed.

1.3 Outside Business Activities (OBA) Disclosure

Eric D. Jackson operates multiple professional activities, including but not limited to insurance and financial advisory services under JIFA, leadership and life coaching under ItsYourLif — Leadership Life Finances LLC, and organizational development services under Transformational Leadership and Culture International LLC (TLCI). These activities are operated separately, with distinct branding, client relationships, and compliance channels.

Insurance and financial services provided through JIFA are governed by this document. Coaching, speaking, and consulting services provided through itsyourlif.com or TLCI are separate and not subject to insurance regulatory oversight. Clients are always clearly informed of which capacity Eric is serving in for any given engagement.

At no time will client information obtained in one professional capacity be used in another without explicit client consent, in compliance with applicable privacy laws.

 

2. PRIVACY POLICY

2.1 Overview — GLBA Privacy Notice

Jackson Insurance & Financial Associates LLC is committed to protecting the privacy of our clients. As a financial services professional, we are required by federal law — specifically the Gramm-Leach-Bliley Act (GLBA) — to explain how we collect, share, and protect your personal financial information.

2.2 Information We Collect

We may collect the following types of personal information to provide services to you:

  • Information you provide to us: name, address, date of birth, Social Security Number (for applications), income, assets, existing coverage details, and other information necessary to apply for insurance or financial products
  • Information from third parties: prior insurance history, motor vehicle reports (MVR), claims history, credit-based insurance scores (where permitted by state law), and information imported via Canopy Connect or Asset-Map
  • Website and technology data: IP addresses, browser type, pages visited, cookies (see Cookie Policy), and other technical data collected automatically when you use our website

2.3 How We Use Your Information

We use your personal information to:

  • Process insurance applications and provide quotes
  • Administer your insurance policies and benefits
  • Respond to your inquiries and service requests
  • Conduct annual reviews and proactive outreach relevant to your coverage
  • Comply with legal and regulatory obligations
  • Improve our services and technology

2.4 Information Sharing

We do not sell your personal information. We may share your information in the following limited circumstances:

  • With insurance carriers, underwriters, and benefits administrators: as required to process applications, issue policies, and administer claims
  • With technology platforms: Canopy Connect, Asset-Map.com, EZ Lynx, Employee Navigator, and other platforms used in the delivery of our services — each subject to their own privacy policies
  • With referral partners or other professionals: only with your explicit consent
  • With regulatory authorities: as required by law or regulatory examination
  • As permitted or required by law: including in response to lawful subpoenas, court orders, or law enforcement requests

2.5 Data Security

We maintain physical, electronic, and procedural safeguards in compliance with applicable federal and state regulations to protect your personal information. Access to client data is limited to authorized personnel with a legitimate business need.

2.6 Your Rights

You have the right to: request a copy of the personal information we hold about you; request correction of inaccurate information; opt out of certain sharing arrangements; and receive a copy of our full privacy notice at any time. Coverage availability, terms, and pricing vary by individual circumstances and are subject to carrier underwriting approval and suitability or best interest.

4.2 Accuracy of Information

We strive to maintain accurate and current information on this website. However, insurance products, carrier offerings, state licensing, and regulations change frequently. We make no warranty, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any information on this site.

4.3 No Investment Advice

Nothing on this website constitutes investment advice, a securities recommendation, or a solicitation to purchase any investment product. Eric D. Jackson is not currently registered as an investment advisor or broker-dealer. 4.4 Limitation of Liability

To the maximum extent permitted by applicable law, JIFA, its members, officers, employees, contractors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of this website or our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of our services shall not exceed the greater of: (a) the total premiums or fees you have paid to us in the 12 months preceding the claim, or (b) $500.

4.5 Third-Party Platforms

Our services incorporate third-party technology platforms including EZ Lynx, Canopy Connect, Asset-Map.com, Employee Navigator, and Microsoft services. Your use of these platforms is subject to their own terms of service, privacy policies, and data practices. JIFA is not responsible for the content, accuracy, security, or availability of third-party platforms.

 

5. DISCLAIMERS & DISCLOSURES

5.1 Insurance Licensing

Eric D. Jackson (NIPR #16544461), and Jackson Insurance & Financial Associates LLC (NPN 20585679), hold insurance licenses in the following states:

  • Arizona — Licensed
  • Colorado — Licensed
  • Michigan — Licensed
  • Texas — Licensed
  • Washington — Licensed

Licensure is required to sell, solicit, or negotiate insurance. We do not conduct insurance activities in states where we are not currently licensed. State licensing information is available through the National Insurance Producer Registry (NIPR) at nipr.com.

5.2 P&C Insurance Disclosure

Property and casualty insurance products are offered through Canyon Lands Insurance / CLI Select and other appointed carriers. Policies are issued by the carrier, not by JIFA. Coverage terms, exclusions, limits, and premiums are determined by each issuing carrier and are subject to carrier underwriting guidelines and applicable state law. JIFA acts as the licensed agent of record for P&C policies sold through our practice.

5.3 Life Insurance & Annuity Disclosure

Life insurance products are offered through direct carrier appointments. Annuity products are insurance contracts, not securities. Fixed and fixed indexed annuities are not FDIC-insured, do not carry a bank guarantee, and may lose value in certain circumstances. Issuing insurance companies are solely responsible for their financial obligations. Past index performance does not guarantee future results.

5.4 Group Benefits Disclosure

Group health, dental, vision, disability, and ancillary benefits are offered in partnership with Emerson Rogers, a wholesale general agency. Individual and group health insurance products are subject to carrier underwriting, state insurance regulations, and applicable provisions of the Affordable Care Act (ACA). JIFA acts as the licensed agent of record for group benefit plans placed through our practice.

5.5 Asset-Map Disclosure

Asset-Map is a financial visualization and planning tool. Use of Asset-Map through JIFA is intended to help clients visualize their financial positions and identify potential planning opportunities. It does not constitute investment advice, tax advice, or legal advice. The information generated by Asset-Map is based solely on the data you provide and is for educational and planning discussion purposes only.

SECTION 5: COMMUNICATIONS CONSENT — CALLS, TEXTS, EMAIL & DIRECT MAIL

5.7 Consent to Contact

By providing your contact information to Jackson Insurance & Financial Associates LLC ('JIFA') — whether through our website, by phone, in person, at an event, or through any other channel — you expressly consent to be contacted by JIFA and its authorized representatives using the contact information provided, including your name, phone number(s), email address, and mailing address, for the purposes of: providing insurance and financial planning quotes and recommendations; following up on inquiries; delivering policy information, renewal notices, and service communications; and periodic marketing communications related to JIFA's services.

5.8 Telephone and Text Message Consent (TCPA)

In accordance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable regulations: By providing your mobile phone number and submitting a form or requesting contact, you expressly consent to receive telephone calls and text messages (SMS and MMS) from JIFA, including calls and texts placed using automated telephone dialing systems (ATDS), pre-recorded messages, or artificial voice technology, at the mobile number you provided.

You understand and agree that:

  • Consent to receive calls or texts is not required as a condition of purchasing any insurance or financial product or service from JIFA.
  • Message and data rates may apply to all text messages, depending on your carrier plan.
  • Message frequency varies based on your service needs and engagement level.
  • You may opt out of text messages at any time by replying STOP to any text message from JIFA. After sending STOP, you will receive a one-time confirmation and no further marketing texts will be sent to that number.
  • For assistance, reply HELP to any text message from JIFA, or contact us at Service@JacksonIFA.com or 480-268-3775.
  • Opting out of text messages does not affect your ability to receive service communications required for active insurance policies or pending transactions.

5.9 Twilio and VOIP Technology Disclosure

JIFA uses Twilio and related VOIP (Voice over IP) communication platforms to facilitate phone calls and text messages for business communications. Your interaction with JIFA may involve the use of cloud-based telephony infrastructure provided by Twilio Inc. and its affiliates. Twilio's privacy policy governs the handling of communication metadata on their platform; JIFA is responsible for the content and purpose of all communications sent through these systems.

JIFA's use of Twilio and VOIP platforms complies with: the Telephone Consumer Protection Act (TCPA); the CTIA Messaging Principles and Best Practices; Twilio's Acceptable Use Policy and Messaging Policy; and applicable state telecommunications laws.

5.10 Call Recording and CRM Documentation

Calls to and from Jackson Insurance & Financial Associates may be monitored, recorded, and/or documented for the following purposes: quality assurance and service improvement; training of staff and authorized representatives; documentation of client requests, policy details, and communications; compliance with applicable insurance regulatory requirements; and accurate and complete client file maintenance.

By initiating or receiving a call with JIFA, you acknowledge and consent to such monitoring and recording. JIFA complies with applicable call recording consent laws:

  • Arizona (ARS § 13-3005): Arizona is a one-party consent state — JIFA, as a party to the call, may record without additional notification. As a best practice, JIFA may announce at the start of calls that the call is being recorded.
  • Multi-state expansion notice: California, Washington, Illinois, Maryland, Massachusetts, Florida, and certain other states require all-party (two-party) consent for call recording. When communicating with clients in these states, JIFA will provide explicit notice and obtain consent before recording.

Call records, logs, and recordings are time and date stamped and stored securely within JIFA's CRM system (EZ Lynx) and associated platforms. Records are retained in accordance with applicable insurance regulatory requirements, which generally require minimum retention of five years for insurance-related communications.

5.11 CRM Documentation, Timestamps, and Client File Notes

All client interactions — including phone calls, text messages, emails, in-person meetings, and online inquiries — are documented in JIFA's Customer Relationship Management (CRM) system, currently EZ Lynx. Documentation includes:

  • Date and time of contact
  • Communication channel (phone, text, email, in person, video)
  • Summary of discussion and any action items or decisions made
  • Notes relevant to your insurance or financial planning needs
  • Any changes to your coverage, policy details, or personal information

This documentation serves as the official record of your relationship with JIFA and supports accurate service delivery, compliance with state insurance regulations, and your protection in the event of any dispute.

5.12 AI-Assisted Communication — Beside AI Receptionist

JIFA uses Beside AI and similar AI-assisted communication tools to support initial phone and message intake, scheduling, and routing. When you contact JIFA, you may initially interact with an automated assistant. You will always have the option to speak with Eric Jackson or a human team member directly. AI-assisted interactions are subject to the same documentation, consent, and privacy standards described in this section.

5.13 Email Marketing — CAN-SPAM Act Compliance

JIFA's email communications comply with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.):

  • All marketing emails clearly identify JIFA as the sender
  • All marketing emails include a valid physical postal address: 7518 E Elbow Bend Rd Ste. B9, Carefree, AZ 85377
  • All marketing emails include a clear and functional opt-out/unsubscribe mechanism
  • Opt-out requests are honored within 10 business days
  • Transactional emails (policy documents, appointment confirmations, service notifications) may still be sent after an opt-out from marketing emails

5.14 Direct Mail

JIFA may send direct mail communications — including insurance quotes, service announcements, renewal reminders, and marketing materials — to clients and prospective clients by postal mail. Direct mail does not require prior consent under federal law; however, JIFA respects opt-out requests for direct mail.

To opt out of JIFA direct mail: contact EDJ@JacksonIFA.com or call/text 480-268-3775 and request removal from direct mail communications. Allow up to 30 days for processing. Note that legally required notices (such as policy cancellation or renewal notices) may still be sent by mail regardless of marketing opt-out status.

5.15 Do Not Call (DNC) Registry Compliance

JIFA respects and complies with the Federal Trade Commission (FTC) National Do Not Call Registry and applicable state DNC registries. JIFA maintains an internal suppression list and scrubs against the National DNC Registry on the schedule required by federal regulations (minimum every 31 days for active telemarketing).

Established Business Relationship (EBR) exception: Under the FTC's rules, JIFA may contact existing clients — including those on the DNC Registry — for up to 18 months after the last insurance transaction, or up to 3 months after an inquiry, without obtaining prior written consent for live calls. Text messages require prior express written consent regardless of EBR status.

6. MULTI-LINE PRACTICE & DATA SHARING DISCLOSURE

JIFA operates across multiple insurance and financial service lines. In serving you, we may engage with multiple carriers, administrators, and technology platforms — each receiving only the information necessary to provide the specific service requested. Specifically:

  • P&C carriers: receive personal and property information for underwriting and quoting
  • Life and annuity carriers: receive health, income, and personal information for underwriting
  • Group benefits carriers and Emerson Rogers: receive employee census data, employer information, and benefit election data
  • Asset-Map: receives financial profile information you voluntarily enter for planning visualization
  • Canopy Connect: receives your carrier login credentials (held securely by Canopy Connect) to import policy data

We use your information only for the purposes for which it was collected and shared, and only with the parties necessary to deliver those services. You may direct us to restrict certain uses of your information at any time by contacting us at EDJ@JacksonIFA.com.

 

7. MEDIATION & DISPUTE RESOLUTION

Any dispute, claim, or controversy arising out of or relating to your relationship with JIFA, including the provision of insurance advisory services, shall first be submitted to non-binding mediation before any formal legal proceedings are initiated. Mediation shall be conducted by a mutually agreed-upon mediator in Maricopa County, Arizona, or via remote video conferencing.

If mediation is unsuccessful, disputes shall be resolved in binding arbitration administered under the rules of the American Arbitration Association (AAA), seated in Maricopa County, Arizona, with one arbitrator. The Federal Arbitration Act governs this provision. Class action arbitration is not permitted.

Nothing in this section limits your right to file a complaint with the Arizona Department of Insurance and Financial Institutions (DIFI) or the applicable state insurance department in your state of residence.

 

8. GOVERNING LAW & JURISDICTION

These terms and your relationship with JIFA are governed by the laws of the State of Arizona, without regard to conflict of law principles. For matters not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona.
